Summary
The court affirmed summary judgment for David Kelly, holding that the alleged agreement to make indefinite payments was too uncertain to enforce and that the fishing quotas were not marital property because they were acquired after the marriage ended and were not supported by any marital expectancy. Because Anna had no marital share in the quotas, the court also upheld denial of her motion to reopen the dissolution under Civil Rule 60(b)(6). FABE, Chief Justice, dissenting, would have treated the increase in quota value attributable to marital labor as divisible marital value and would have reversed.
