Summary

The court held that a borrower’s reinstatement amount may include all reasonable costs incurred in pursuing a nonjudicial foreclosure, even when the deed of trust does not expressly authorize those charges. It also held that the Unfair Trade Practices and Consumer Protection Act does not apply to nonjudicial deed of trust foreclosures because those transactions are not transactions involving goods or services under the Act. The court therefore reversed the superior court’s partial summary judgment rulings and remanded for further proceedings.
