Summary
The court reversed the superior court's conclusion that the Alaska Constitution requires DNR to issue a written best-interest finding at every phase of a multiphase oil and gas project. It held that the legislature may require only one written finding for the lease-sale phase and that later phases are not separate statutory disposals. The court nevertheless held that the State must continue to consider cumulative impacts and take a continuing hard look at the public interest as later project information becomes available.
