Summary
The court affirmed summary judgment for Credit Union 1 because Charles failed to raise a genuine issue of material fact that he was an intended third-party beneficiary of any alleged agreement to provide liability insurance. The court assumed for purposes of analysis that such an agreement and promise to provide insurance might have existed, but found no evidence that the insurance was intended to benefit Charles. The court therefore did not reach whether a contract existed, whether it was breached, or whether the superior court properly struck the deposition testimony.
