Alaska Supreme Court

Irene M. Bedard Wilson, Appellant v. Dennis E. Wilson, Jr., Appellee

March 9, 20122012 Alas. LEXIS 43

Summary

The Alaska Supreme Court held that a superior court may decline to issue an otherwise available divorce decree when the parties have an adequate alternative forum and an Alaska decree could significantly affect related custody or property proceedings there. Because Ohio was exercising jurisdiction over the parties' divorce-related matters, Irene identified no impediment to obtaining a divorce in Ohio, and an Alaska decree could prejudice the parties through timing effects on property division, the dismissal was not an abuse of discretion. The court therefore affirmed.
