Justice Winfree, joined by Justice Stowers, dissented from the court's decision to use the April 5 Amended Proclamation Plan for the 2012 elections. He would have used the May 15 reformulated Southeast Alaska plan because the April 5 plan appeared to violate the Alaska Constitution, while the record did not show that the Voting Rights Act required preserving a Southeast influence district. Justice Stowers separately dissented and likewise would have required use of the May 15 plan, emphasizing that the court had reversed its prior constitutional directive without new evidence.
