The Alaska Supreme Court affirmed summary judgment for the Borough on the homeowners' Open Meetings Act and due process claims and affirmed the denial of attorney's fees. It held that the site inspection was a meeting but was adequately noticed and properly convened, and that any due process deficiency was cured by the Planning Commission's de novo hearing. The court reached the otherwise moot Open Meetings Act claims solely to resolve prevailing-party status for fees. Justice Stowers, joined by Justice Christen, would have remanded for clarification of the attorney's-fee ruling against Gold Country.
