Alaska Supreme Court
Bradley Shaffer, Appellant v. Kenneth Bellows, Ronald D. Bellows, and Marlys Dee Hanson, Appellees
September 23, 20112011 Alas. LEXIS 99
Summary
The court affirmed the interpretation of the option agreement as giving Shaffer a right to purchase the island only if Bellows elected to sell it. It reversed the summary judgment rulings on Shaffer's fraudulent-conveyance and contractual claims because material factual disputes existed concerning the transfer to Bellows's sister and its effect on the option agreement. The court also directed the superior court to address whether the option was an unreasonable restraint on alienation and, if so, the consequences of that determination.
