Summary

The court held that Alyeska qualified as a statutory project owner under the Alaska Workers' Compensation Act and therefore was immune from Anderson's negligence suit under the exclusive-liability provisions. It affirmed summary judgment dismissing the suit but held that Alyeska's nominal, early offer of judgment was invalid and could not support Rule 68 attorney's fees, remanding for an award of Rule 82 fees. Justice Christen, dissenting in part, would have affirmed the Rule 68 fee award because Alyeska disclosed its legal theory and made a reasonable early settlement effort.
