Summary

The court held that the initiative petition summary was inaccurate and impartial because it omitted that the measure would restrict existing law, modify and revive a previously invalidated statutory scheme, and expose violating physicians to felony penalties. It nevertheless affirmed allowing the initiative to proceed to the ballot without recirculating the petition because the omissions did not substantially misrepresent the measure, signer inadvertence was unlikely or minimal, recirculation would substantially burden the sponsors, and opponents would suffer little hardship if a corrected summary were used. WINFREE, Justice, concurring in part and dissenting in part, agreed that the summary was defective but would have required a new petition and signatures.
