Supreme Court of Alabama

Construction Services, LLC, d/b/a MCA Construction, Inc. v. RAM-Robertsdale Subdivision Partners, LLC, Retail…

June 18, 2026

Summary

The court held that a general contractor's failure to possess a particular work classification when it executed a construction contract does not automatically render the contract void when the contractor held a valid general-contractor license, substantially complied with the licensing scheme, and did not attempt to circumvent it. Because the record did not establish that the public-policy rule against recovery by unlicensed contractors applied, the circuit court's summary judgment for the defendants was erroneous. The judgment was reversed and the case was remanded for further proceedings.
