Summary

The Supreme Court of Alabama held that the Turners' claims were at least arguably connected to a baiting agreement containing a broad arbitration clause and a clear delegation of arbitrability questions to the arbitrator through incorporation of the AAA rules. Accordingly, the trial court, rather than the arbitrator, could not decide whether the claims arising from the inspection report fell within the baiting agreement. The court reversed the denial of arbitration and remanded for an order compelling arbitration and staying the action.
