Supreme Court of Alabama
Stacy G. Coats and Kendall Coats v. Sandra F. Ayers, Tommy J. Ayers, and J. Jason Ayers (Appeal from Tuscaloosa…
June 14, 2024
Summary
The court held that the plaintiffs could not pursue a statutory right-of-way to the western portion of the section 15 property because that property, treated as one tract, bordered a public road. It nevertheless held that summary judgment was improper as to the separate section 10 property because evidence showed that the property remained landlocked and that the proposed route, together with permission to cross an intervening parcel, could provide reasonable access. The judgment was therefore reversed and remanded for further proceedings.
