Supreme Court of Alabama
Red Mountain Diagnostics, LLC, Donald R. Simmons, and William T. DeVos v. Robert A. Black
September 20, 2024
Summary
The court held that the preliminary injunction requiring the Red Mountain parties to deposit and preserve joint-venture funds was improper because Black and MDL failed to present evidence of imminent irreparable harm or the absence of an adequate remedy at law. The court therefore reversed the injunction order and remanded the case. Because the injunction was dissolved, the requests for a stay and for an increased injunction bond were moot.
