Summary
The Court held that the Board of Trustees of the University of Alabama is absolutely immune from suit under Article I, § 14 of the Alabama Constitution. Because that immunity is a nonwaivable jurisdictional bar, the circuit court lacked authority to compel the Board to arbitrate and was required to dismiss the claims against it. The Court granted mandamus and directed the circuit court to vacate the arbitration order as to the Board and dismiss the claims against it.
