Supreme Court of Alabama
Eickhoff Corporation v. Warrior Met Coal, LLC
May 4, 2018265 So. 3d 216
Summary
The court held that the parties' incorporation of the AAA commercial arbitration rules clearly and unmistakably delegated arbitrability questions to the arbitrator. Because Warrior Coal's claims were at least arguably connected to the master service agreements containing the arbitration provisions, the trial court was required to compel arbitration and stay the litigation rather than decide which contract governed. Justice Parker, dissenting, would have held that a general reference to the AAA rules did not clearly and unmistakably delegate arbitrability to the arbitrator.
