Summary
The court held that Alabama's insurable-interest requirement for personal insurance must exist when the policy becomes effective and does not restrict a later change of beneficiary on a validly issued policy. It nevertheless affirmed the reversal of the dismissal because the complaint plausibly alleged negligence by the insurer, and the policy and ownership facts had not yet been developed. The judgment was therefore affirmed in part, reversed in part, and remanded.
