The dissent argued that applying the putative-father registry and implied-consent provisions to a father who had supported the mother and child, was known to the mother and adoptive parents, and was deceived about the child's death violated substantive due process, and that the father preserved that argument. Justice Shaw, dissenting separately, likewise would have held that the constitutional issue was preserved.
