Supreme Court of Alabama

Southeast Construction, L.L.C. v. War Construction, Inc.

June 26, 20152015 Ala. LEXIS 83

Summary

The court held that WAR satisfied its obligation to provide the required releases because SEC received the original adequate release and the circuit court could treat the prescribed exchange procedure as waived or modified. It held, however, that the circuit court violated the law of the case by calculating interest from the arbitration-award date rather than from September 8, 2014, when WAR notified the court that it had supplied the required releases. The judgment was therefore affirmed in part, reversed in part, and remanded with instructions to recalculate interest.
