Supreme Court of Alabama
Ex Parte Lisa Hanvey. (in Re Madison Academy, Inc. v. Lisa Hanvey)
January 30, 20152015 Ala. LEXIS 6
Summary
The Supreme Court of Alabama held that substantial evidence supported the trial court's finding that Lisa Hanvey's workplace exposure to chemical fumes permanently and totally disabled her by worsening and accelerating her preexisting myasthenia gravis. The court concluded that her subsequent remission did not eliminate the evidence that physical labor and workplace chemical exposure would cause recurring symptoms, and that her limitations, education, and vocational evidence prevented her from obtaining other gainful employment. The court reversed the Court of Civil Appeals' judgment and remanded the case. MURDOCK, Justice, dissenting, would have upheld the Court of Civil Appeals' causation analysis that Hanvey recovered from the work-related effects and was disabled by her underlying condition.
