Supreme Court of Alabama
Jewel Campbell v. Ethel C. Taylor; Gladys A. Campbell and Paula Buettner v. Jewel Campbell
July 3, 2014159 So. 3d 4
Summary
The court affirmed the summary judgment denying the plaintiffs' Rule 60(b)(4) request to set aside an estate-distribution judgment as void. It held that failure to join necessary or indispensable parties does not deprive a court of subject-matter jurisdiction, and the plaintiffs did not establish a lack of personal jurisdiction warranting relief. The cross-appeal concerning the denial of a motion to strike affidavits was dismissed as moot. MURDOCK, Justice, concurring in part, agreed with the conclusion concerning nonjoinder but disagreed with the majority's notice rationale and would affirm on waiver and participation grounds.
