Supreme Court of Alabama

Jim Cody Beddingfield, Jimmy Larry Beddingfield, and Rebecca M. Beddingfield v. Trace Rex Linam

March 8, 20132013 Ala. LEXIS 17

Summary

The court held that the evidence did not support negligent-entrustment, negligent-supervision, or wanton-supervision claims against the injured boy's parents, and that ordinary consumer bottle-rocket use was not an abnormally dangerous activity supporting strict liability. It rendered judgment for the parents on all claims and for the boy on the strict-liability claim. Because the unsupported strict-liability claim was submitted with otherwise viable claims against the boy and the jury returned a general verdict, the court ordered a new trial on the remaining claims against him.
