Summary

The Alabama Supreme Court affirmed the trial court’s summary judgment that Hubert M. Norris was not qualified to be appointed a supernumerary sheriff because his felony conviction forfeited all of his pre‑conviction service credit, and that Governor Riley properly rescinded Norris’s appointment. The Court applied a de novo review of the statutory qualifications and rejected Norris’s argument that only the term during which he was convicted should be forfeited. Justice Murdock dissented, contending that the forfeiture should be limited to the term of office at the time of conviction.
