Summary

The court affirmed summary judgment for the defendants because the contract requiring Trapp to purchase subdivision lots was void under the Madison County Subdivision Regulations. The regulation prohibited selling or offering lots for purposes of creating, establishing, or modifying a subdivision before approval of the proposed plat, and the contract violated that prohibition. The court did not decide whether the contract also violated the state subdivision-control statute, and held that LCD's other contract-dependent claims likewise failed.
