Summary

The court held that the Talladega Circuit Court, having first exercised jurisdiction over the parties and their property in the divorce action, had the exclusive right to resolve the parties' dispute concerning operation of their jointly owned LLC. It therefore granted Ronda McMichael's mandamus petition and directed the Calhoun Circuit Court to stay the parallel declaratory-judgment action. The court transferred Forney McMichael's petition to the Court of Civil Appeals because review of the domestic-relations contempt issues lay within that court's jurisdiction, and directed that the contempt challenge be treated as a timely appeal. MURDOCK, Justice, concurred in the result for case no. 1090150 but would have reached and resolved the subject-matter-jurisdiction issue in case no. 1090179 rather than transferring it.
