Summary

The Supreme Court held that NEPA does not require the Surface Transportation Board to analyze environmental effects of upstream oil drilling or downstream refining projects that are separate in time or place from the railroad project, and that the D.C. Circuit failed to give the Board the substantial deference required. Accordingly, the Court reversed and remanded the appellate decision.
