Summary

The Supreme Court denied the applications for stay of the Environmental Protection Agency’s rule. The majority found that, although the applicants showed a strong likelihood of success on the merits, they were unlikely to suffer irreparable harm before the D.C. Circuit decides the case, so a stay was unwarranted. Justice Thomas would have granted the stays, and Justice Alito recused himself. The Court indicated that further relief could be sought after the appellate decision.
