Summary

The Court held that a former President is absolutely immune from criminal prosecution for conduct within his exclusive constitutional authority and is entitled to at least presumptive immunity for other official acts, but has no immunity for unofficial conduct. The Court vacated the D.C. Circuit’s judgment and remanded for factual determination of which allegations are official and whether the government can overcome the presumption of immunity.
