Summary

Per Curiam opinion denies stay of execution and habeas petition. The Court concludes there is no likelihood of congressional or state legislative action to address the treaty violation, and such obligations are not enforceable as domestic law without implementation. The United States does not represent prejudice from lack of consular access. Justices Stevens, Souter, Ginsburg, and Breyer would grant a stay pending further consideration.
