Summary

The Court held that the federal statute protecting California's milk-composition and labeling laws did not clearly exempt the State's milk-pricing and pooling laws from Commerce Clause review. It also held that the absence of an express residence- or citizenship-based classification did not justify rejecting the individual farmers' Privileges and Immunities Clause claim at the pleading stage. The Court vacated and remanded without deciding either constitutional claim. Justice Thomas, concurring in part and dissenting in part, would have affirmed on the Commerce Clause issue because he would reject the negative Commerce Clause as a basis for invalidating state legislation.
