The Court held that a corporate employee and the corporation he owns are distinct entities for purposes of the RICO provision requiring a person to conduct an enterprise's affairs through a pattern of racketeering activity. Formal incorporation satisfies the distinctness requirement, and the provision applies whether the employee acted within or beyond the scope of corporate authority. The Court therefore reversed the dismissal and remanded for further proceedings.
