Summary

Justice Souter's dissent argues that the Court should not have intervened in Florida's election dispute and that the federal statutory and Article II questions were insubstantial. He concludes that the Florida Supreme Court reasonably interpreted Florida's election-contest statute and that the equal-protection problem created by differing ballot-counting standards should have been remedied by a uniform recount rather than by ending the recount. Justice Breyer, Justice Ginsburg, Justice Stevens, and Chief Justice Rehnquist also filed separate opinions, contesting the majority's intervention, reasoning, or proposed remedy in different respects.
