Supreme Court of the United States
Price Waterhouse v. Hopkins
May 1, 1989490 U.S. 228
Summary
The Court held that a Title VII plaintiff proves a mixed-motive violation by showing that sex was a motivating factor in the employment decision, after which the employer may avoid liability only by proving by a preponderance of the evidence that it would have made the same decision without considering sex. The Court also held that sex stereotyping is relevant evidence of sex-based decisionmaking and rejected the clear-and-convincing standard applied below. It reversed the judgment against Price Waterhouse and remanded for determination under the preponderance standard.
