Bond v. Floyd

Summary

The Court held that Georgia could not exclude a duly elected legislator from membership because of his opposition to the Vietnam War and the Selective Service system. Although legislators may be required to take an oath supporting the Constitution, that requirement does not authorize legislators to evaluate a colleague's sincerity or restrict his policy views under the guise of testing constitutional loyalty. The Court reversed because Bond's statements were protected expression under the First Amendment.
