Summary

The Court held that Texas's statutory delegation of authority to the Democratic State Executive Committee made the committee an instrument of the State when it excluded Black voters from the primary based on race. Because the exclusion was state action denying equal protection, the judgment dismissing the damages action was reversed and the case remanded. Justice McReynolds, dissenting, would have treated the exclusion as private party action and affirmed.
