Summary

The Court held that the 1897 federal statute prohibiting the sale of liquor to Indians does not apply to an Indian who, having received an allotment and patent under the 1887 Act, is a citizen of the United States and of the State of Kansas and therefore subject to state law. Consequently the conviction was reversed and the petitioner discharged.
