U.S. Court of Appeals for the Third Circuit
National Shooting Sports Foundation v. Attorney General New Jersey
September 8, 2026
Summary
The Court held that NSSF has Article III standing to challenge New Jersey's firearms regulation because the State's enforcement actions against NSSF members and closely related businesses created a substantial and credible risk of enforcement. It also held that Younger abstention does not apply because NSSF is not a party to the state enforcement action, lacks the ownership, control, or management relationship that could support an exception, and its federal suit would not directly interfere with that proceeding. The Court therefore reversed the District Court's abstention ruling.
